PickaWhen is a free scheduling tool. Create a poll with available times, share the link, and let people book. No account needed.

Acceptance of Terms

By accessing or using PickaWhen, you agree to be bound by these Terms of Service. If you don't agree, please don't use the service.

Service Description

PickaWhen provides a web-based scheduling tool that allows users to:

• Create polls with available time slots
• Share polls via unique links
• Allow participants to book time slots
• Receive email notifications about bookings

Eligibility

You must be at least 16 years old to use this service. By using the service, you represent that you meet this age requirement.

Optional sign-in and private links

You can create polls and respond without signing in. Optional My planning verifies your email and lists the polls created with that address. Keep your email account, sign-in links, admin links and private response links secure. Signing out ends the current session; it does not delete your polls or preferences.

Acceptable Use

You agree NOT to use PickaWhen to:

• Send spam, phishing attempts, or unsolicited bulk messages
• Harass, threaten, or intimidate others
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Overload our servers with excessive requests
• Collect or harvest user data
• Use automated tools or bots to create polls or bookings
• Impersonate another person or entity
• Upload malicious content or links

We reserve the right to suspend or terminate access for anyone who violates these terms, without prior notice.

User Content

You are responsible for all content you create (poll titles, descriptions, locations). You agree not to create content that is:

• Illegal or promotes illegal activities
• Defamatory, harassing, or threatening
• Infringing on intellectual property rights
• Contains personal data of others without their consent

By creating content on PickaWhen, you grant us a limited license to display and transmit that content as necessary to provide the service.

Data Handling

Polls expire one year after creation and daily cleanup removes them. You can delete a live poll sooner through its admin link. Session, preference and backup retention are explained in the privacy notice.

Disclaimer of Warranties

PickaWhen is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free service
• Accuracy or reliability of any information
• That defects will be corrected

Limitation of Liability

To the maximum extent permitted by law, SK_insights and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Missed meetings or scheduling conflicts
• Email delivery failures
• Service interruptions or downtime
• Actions of third parties

Our total liability for any claim shall not exceed the amount you paid for the service (which is €0 for this free service).

Indemnification

You agree to indemnify and hold harmless the service operators from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Service Availability

We strive to maintain high availability, but we do not guarantee:

• 100% uptime
• That the service will be available in your region
• That the service will continue indefinitely

We reserve the right to modify, suspend, or discontinue the service at any time, with or without notice.

Intellectual Property

The PickaWhen name, logo, and software are our intellectual property. You may not use our trademarks without permission. Open source components are subject to their respective licenses.

Third-Party Services

We use third-party services (email delivery, hosting) to operate. Your use of our service is also subject to their terms. We are not responsible for third-party service failures.

Modifications to Terms

We may update these terms at any time. Changes become effective when posted. The date at the top indicates the last update. Continued use after changes constitutes acceptance.

Termination

You may stop using the service at any time. We may terminate your access if you violate these terms. Upon termination, your right to use the service ceases immediately.

Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in effect.

Governing Law

This agreement and the use of this website are governed exclusively by Dutch law. Any disputes arising from this agreement shall be submitted to the exclusive jurisdiction of the Court of Rotterdam, the Netherlands.
